Rover Exotics Rescue LLC

Welcome to Rover Exotics Rescue LLC ("we," "us," or "our"), a California-based organization operating in the City of Los Angeles. These Terms of Service ("Terms") govern your interaction with Rover Exotics Rescue LLC, including but not limited to adoption services, volunteer activities, donations, and any other engagement with our organization, whether in person, online, or otherwise. By engaging with us, you agree to be bound by these Terms. If you do not agree, please refrain from interacting with Rover Exotics Rescue LLC.

1. Acceptance of Terms

By accessing our services, adopting an animal, volunteering, making a donation, or otherwise engaging with Rover Exotics Rescue LLC, you acknowledge that you have read, understood, and agree to these Terms. We reserve the right to update or modify these Terms at any time, with or without notice, and your continued engagement constitutes acceptance of any changes.

2. Services Provided

Rover Exotics Rescue LLC is a private organization dedicated to the rescue, rehabilitation, and rehoming of exotic animals. Our services include animal adoptions, educational outreach, and community support programs, all provided at our sole discretion and subject to availability.

3. Adoption and Participation

Adoption Process: All adoptions are subject to approval by Rover Exotics Rescue LLC. We reserve the right to deny any adoption application for any reason, including but not limited to concerns about animal welfare.
Volunteer and Donor Participation: Participation as a volunteer or donor is voluntary and does not create an employment or contractual relationship with Rover Exotics Rescue LLC beyond these Terms.

4. Liability Waiver

You agree that Rover Exotics Rescue LLC, its owners, employees, volunteers, and affiliates are not liable for any damages, injuries, or losses arising from your interaction with our organization, including but not limited to animal behavior, property damage, or personal injury. You assume all risks associated with engaging with our services.

5. Dispute Resolution and Legal Restrictions

a. Waiver of Class Action Lawsuits

You agree that any dispute arising out of or relating to these Terms or your engagement with Rover Exotics Rescue LLC will be resolved on an individual basis only. To the fullest extent permitted by law, you expressly waive any right to participate in a class action lawsuit, class arbitration, or any other collective proceeding against Rover Exotics Rescue LLC, its owners, employees, or affiliates.

b. Prohibition on Suing Owners or Company

To the fullest extent permitted by California law, you agree not to initiate any lawsuit, claim, or legal action against Rover Exotics Rescue LLC, its owners, employees, volunteers, or affiliates for any reason related to your interaction with our organization. Any disputes must be resolved through informal negotiation or, if necessary, binding individual arbitration as outlined below.

c. Binding Arbitration

Any dispute that cannot be resolved informally will be submitted to binding arbitration in the City of Los Angeles, State of California, conducted by a single arbitrator under the rules of the American Arbitration Association (AAA) and in accordance with the California Arbitration Act (California Code of Civil Procedure § 1280 et seq.). The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court having jurisdiction. You acknowledge that by agreeing to arbitration, you are waiving your right to a jury trial.

Notice: UNDER CALIFORNIA LAW, YOU ARE AGREEING TO RESOLVE DISPUTES THROUGH ARBITRATION INSTEAD OF IN COURT. THIS MEANS YOU ARE GIVING UP CERTAIN RIGHTS, INCLUDING THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION.

d. Waiver of Court Costs and Attorneys’ Fees

To the fullest extent permitted by law, you agree to waive any claim to recover court costs, attorneys’ fees, or any other legal expenses from Rover Exotics Rescue LLC, its owners, or affiliates, regardless of the outcome of any dispute. Each party will bear its own costs in any arbitration or legal proceeding, unless otherwise required by applicable California law (e.g., if a court or arbitrator determines that a provision is unconscionable or unenforceable).

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action that is not subject to arbitration will be brought exclusively in the state or federal courts located in Los Angeles County, California.

7. Indemnification

You agree to indemnify, defend, and hold harmless Rover Exotics Rescue LLC, its owners, employees, volunteers, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your interaction with our organization.

8. Termination

We reserve the right to terminate your access to our services, including adoption privileges, volunteer opportunities, or any other engagement, at our sole discretion, with or without cause and without notice.

9. Severability

If any provision of these Terms is found to be unenforceable or invalid under California law, the remaining provisions will continue in full force and effect to the maximum extent permissible.

10. Entire Agreement

These Terms constitute the entire agreement between you and Rover Exotics Rescue LLC regarding your engagement with us and supersede any prior agreements or understandings, whether written or oral.

By engaging with Rover Exotics Rescue LLC, you acknowledge that you have read and agree to these Terms of Service in their entirety.
